BackupHuman Terms of Service

These terms are an agreement between you and Iron Latch Enterprises LLC, operating as BackupHuman. By creating an account or using the service, you agree to them.
1. What BackupHuman is, and what it is not
BackupHuman sends you scheduled text-message check-ins. If you do not respond, it escalates: a reminder, then a warning, then text alerts to the people you designated (your Backup Humans) so someone can check on you and your pets.
BackupHuman is not an emergency service. It does not contact 911, police, fire, or medical services under any circumstances. It sends text messages to the friends you chose. It does not guarantee that any message will be delivered, that any Backup Human will see an alert, or that anyone will act on one. If you are in danger or having an emergency, call 911 or your local emergency number. Do not rely on BackupHuman as your only safety arrangement.
2. Eligibility
You must be 18 or older, be able to receive SMS at a US mobile number, and provide accurate account information.
3. Your responsibilities
Your Backup Humans are people you choose, and adding them is on you. You confirm that you personally know each person you add, that you have their permission or a reasonable belief they are willing to receive these texts, and that the phone numbers you provide are correct. We send each person a consent request and they receive no alerts unless they agree; but the decision to give us their number is yours, and you agree to answer for it if you add someone without any basis to believe they were willing.
You are responsible for keeping your schedules realistic and your contact information current. A check-in sent to an old number helps no one.
4. Text messaging
By creating an account you consent to receive automated SMS from BackupHuman at the number you provide, including check-ins, reminders, warnings, and account notices. Message frequency varies with your settings. Message and data rates may apply and are between you and your carrier. Reply STOP to opt out, START to resume, HELP for help. Opting out of check-ins means the service cannot function for you.
5. Plans, trials, and billing
BackupHuman offers a free trial and paid plans with different limits on Backup Humans and schedules. Trial terms, including length, are stated at signup and may change for future signups. When a trial ends without an upgrade, the account moves to the free plan and its limits. Paid plans are billed through Stripe, monthly or yearly, and renew automatically until canceled. You can cancel anytime; cancellation stops future charges and does not refund past ones except where the law requires. We may change plan pricing or features with advance notice; changes apply at your next renewal.
6. Acceptable use
Do not use BackupHuman to harass anyone, to send messages to people who have not agreed to receive them, to monitor someone without their knowledge, or for any unlawful purpose. Do not attempt to probe, disrupt, or overload the service. We may suspend or terminate accounts that violate these terms, and we may refuse service where we reasonably believe the service is being misused.
7. Availability
We work to keep BackupHuman running, but we do not promise uninterrupted service. SMS delivery depends on carriers and infrastructure we do not control. Scheduled maintenance, carrier outages, and events beyond our control can delay or prevent messages. This is a further reason Section 1 matters: the service is a helpful layer, not a guarantee.
8. Disclaimers and limits of liability
The service is provided as is, without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, including damages arising from a message that was delayed, not delivered, or not acted upon. Some jurisdictions do not allow certain limitations; where the law does not permit a limitation, it does not apply.
9. Indemnification
If you add someone's number without any basis to believe they consented, and we face claims because of it, you agree to indemnify us for those claims.
10. Termination
You can close your account at any time by emailing support@backuphuman.com. We can suspend or terminate accounts for violations of these terms, for non-payment, or if we discontinue the service, with notice where practicable. Sections that by their nature survive termination (including 8 and 9) survive.
11. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
12. Changes
We may update these terms. For material changes we will notify account holders by email before the changes take effect; continued use after that is acceptance.
